By accessing or purchasing from Palm & Pear Creative ("we," "us," or "our"), operated by ThompsonBlack LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our store.

1. Products & Services

Palm & Pear Creative sells two categories of products:

Digital Products: Premade book covers, flat lays, templates, and other digital designs delivered electronically as downloadable files immediately upon purchase. Digital products are not physical goods and are not shipped.

Physical Products: Print-on-demand merchandise (apparel, accessories, and other branded or bookish goods) produced and fulfilled by our third-party print partner, Printify. Physical products are printed after your order is placed and shipped directly to you by the print provider.

2. Premade Book Cover License

Each premade book cover purchase grants the buyer a single-use, exclusive, commercial license to use the cover design for one (1) book title across all formats and editions of that title (ebook, paperback, hardcover, audiobook). Upon purchase, the cover is permanently removed from our store and will not be resold to another buyer.

You may:

  • Use the purchased cover for one book title across all formats (ebook, print, audio)
  • Use the cover in marketing and promotional materials for that specific book

You may not:

  • Resize, reformat, crop, or otherwise alter the cover file for different platform specifications (e.g., adapting an ebook cover for audiobook, KDP for IngramSpark, etc.)—all reformats must be requested through Palm & Pear Creative to ensure the design remains intact and are subject to an additional formatting fee
  • Modify, alter, or create derivative works from the core illustration, artwork, or design elements of the cover
  • Resell, sublicense, or redistribute the cover file to any third party
  • Use the same cover design on more than one book title
  • Use the cover for any purpose other than as a book cover (e.g., merchandise, branding, logos, social media templates)
  • Represent a modified version of the cover as a Palm & Pear Creative design

Intellectual property: The purchase of a premade cover grants a license to use the design as described above. It does not transfer ownership of the underlying artwork, illustrations, or design elements, which remain the intellectual property of Palm & Pear Creative / ThompsonBlack LLC. Unauthorized modification of the cover — particularly any modification that is then attributed to or represented as a Palm & Pear Creative design — constitutes a violation of these terms and may result in revocation of the license.

Additional formatting: If you need your cover reformatted for a different platform, trim size, or use case (e.g., audiobook square, different print distributor specifications, hardcover wrap), contact us to request a reformat. Reformats are billed at our current hourly rate and are typically completed within 3–5 business days.

Delivery: Premade covers require customization before final delivery. Upon purchase, you will be asked to complete a form to capture the details and provide the information needed to finalize your cover (author name, book title, subtitle, series information, and any color preferences, where applicable).

Cover customization begins once this form is submitted. If details for the ebook and paperback wrap files are submitted together, you will receive both files within 5-7 business days. If submitted separately (not within the same 24-hour period), each file will be delivered within 5-7 business days of receiving the corresponding details.

Your finalized cover files will be delivered via a secure download link.

License terms for other digital products are specified on each product listing.

3. Pricing & Payment

All prices are listed in US dollars (USD) and are subject to change without notice. Applicable sales tax will be calculated and applied at checkout based on your location, as required by law.

Payments are processed securely through Shopify Payments. We do not store your credit card information on our servers.

4. Returns, Refunds & Exchanges

Digital Products (Premade Covers): Due to the nature of digital goods and the exclusive licensing model (covers are permanently removed from our store upon sale), all sales of premade book covers are final. No refunds will be issued.

If you experience a technical issue with your download (corrupted file, download link not working), contact us at info@palmandpearcreative.com and we will resolve it promptly.

Physical Products (Print-on-Demand Merch): Because our physical products are printed on demand specifically for your order, we can only accept returns or exchanges in specific situations.

We will issue a replacement or refund if your item arrives:

  • Damaged or defective
  • Materially different from the product listing (wrong item, wrong print)
  • Lost in transit (after a reasonable shipping window has passed)

To request a replacement or refund for a damaged/defective item, contact us within 14 days of delivery at info@palmandpearcreative.com with your order number and a photo of the issue. Refunds for physical products, when approved, will be processed to the original payment method within 5–10 business days.

5. Shipping & Fulfillment

Digital products are delivered electronically. No shipping is required.

Physical products are produced and shipped by our print-on-demand fulfillment partner. Production typically takes 2–5 business days, and shipping times vary by destination. Estimated delivery times are provided at checkout but are not guaranteed. We are not responsible for delays caused by the carrier, customs, or events outside our control.

Tracking information will be emailed to you once your order ships. If your order has not arrived within the estimated delivery window, contact us and we will investigate with our fulfillment partner.

Special editions and special orders ship on a case-by-case basis. Estimated production and shipping timelines will be communicated before purchase and updated throughout the process as often as possible after purchase.

These items ship from Florence, SC, USA via USPS or UPS unless otherwise noted.

6. Accounts

You may create an optional account on our store. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and current information when creating your account.

We reserve the right to suspend or terminate accounts that violate these terms.

7. Intellectual Property

All content on this site—including, but not limited to, cover artwork, illustrations, designs, logos, product images, and written copy—is the property of Palm & Pear Creative or its licensors and is protected by copyright and other intellectual property laws.

Purchasing a product does not transfer ownership of the underlying artwork or intellectual property. Your purchase grants only the specific license described in these terms (see Section 2 for premade cover licenses).

8. Limitation of Liability

To the fullest extent permitted by law, Palm & Pear Creative and ThompsonBlack LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our store or purchase of our products.

Our total liability for any claim arising from a purchase shall not exceed the amount you paid for the specific product at issue.

We provide premade covers "as-is" for book cover use. We do not guarantee that a cover design will result in book sales, meet specific retailer requirements beyond standard specifications, or be suitable for any particular purpose beyond its intended use as a book cover.

We provide premade and custom graphics for use on social media or in client communication. We do not guarantee that any graphic will result in conversion to sales, page reads, or sign-ups, meet specific platform requirements beyond standard specifications, or be suitable for any other particular purpose beyond its intended use.

9. Modifications to Terms

We reserve the right to update or modify these Terms of Service at any time. Changes take effect immediately upon posting to this page. Your continued use of the store following any changes constitutes acceptance of those changes. We encourage you to review these terms periodically.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of South Carolina, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of the store shall be resolved in the courts of Florence County, South Carolina.
